Terms of service

As of September 2026

This English version is a reading aid only; the German version remains the legally binding text and prevails in case of any discrepancy.

These terms apply to all orders for material and to all workshop bookings made through this shop.

1. Who we are and who these terms apply to

The contracting party is MATEREA Handels GmbH, Dobler Straße 2, 8502 Lannach, Austria (hereinafter Materea). The complete company details are in the Legal notice.

Materea sells exclusively to entrepreneurs within the meaning of § 1 of the Austrian Commercial Code (Unternehmensgesetzbuch, UGB), that is, to businesses that purchase the ordered material or the workshop in the course of their commercial activity. An account is only approved after the company details have been checked. Consumer transactions are not concluded through this shop. By placing an order you confirm that you are acting as an entrepreneur.

Only these terms apply. Deviating terms of your business do not become part of the contract, even if we do not expressly object to them.

2. How the contract is formed

The presentation of the products in the shop is not yet an offer but an invitation to you to make one. By submitting the order you make a binding offer. The automatic confirmation of receipt is not yet an acceptance. The contract is formed as soon as we expressly confirm the order or dispatch the goods.

Before submitting, you can check and change your entries in the cart. We store the order data and send it to you by email with the order confirmation. You can access, print and save these terms on this page at any time.

3. Prices

All prices in the shop are net prices in euros and are exclusive of statutory VAT. Shipping costs are added; they are shown in the cart before you submit the order. The scale of rates is set out on the page Shipping and payment.

For intra-Community supplies to businesses with a valid VAT ID number we invoice without VAT as soon as the conditions for this are met. We check your VAT ID for this in the EU confirmation procedure.

4. Payment

The available payment methods are credit card, EPS, Klarna, PayPal and pay by invoice. Apple Pay and Google Pay are handled as card payments. You can see at the checkout which payment method your account can use.

If you pay by invoice, the invoice amount is due for payment within 7 days of the invoice date without deduction.

If you fall into default, statutory default interest under § 456 UGB accrues. You bear the costs of appropriate debt collection.

5. Retention of title

The delivered goods remain our property until they have been paid for in full. If you process goods subject to retention of title, you do so on our behalf, without any obligation arising for us as a result.

6. Shipping, delivery and transfer of risk

We deliver to Austria and Germany. Collection from our warehouse in Lannach is possible by arrangement.

Shipping is at your cost and risk: in the case of dispatch, the risk passes to you as soon as we have handed the goods over to the carrier. Partial deliveries are permitted insofar as they are reasonable for you; we bear any additional costs arising from them.

Delivery dates are non-binding unless we expressly confirm them in writing as binding.

7. Inspection and notice of defects

You must inspect the goods without undue delay after receipt and give written notice without undue delay of any apparent defects, shortages or wrong deliveries (§ 377 UGB). Hidden defects must be notified without undue delay after their discovery. If notice is not given, the goods are deemed approved.

Please report transport damage to the delivery person immediately on taking delivery and notify us of it.

8. Warranty

The statutory warranty provisions for transactions between entrepreneurs apply. We warrant the promised properties of our products in accordance with the respective technical data sheets.

Our materials are applied to substrates that we do not know and cannot inspect. Details of consumption, build-up and drying times are guide values from our data sheets. Whether a substrate is suitable must be assessed on site by the business carrying out the application, if in doubt by means of a test area. We provide no warranty for defects that are due to an unsuitable substrate, to application contrary to the data sheet or to the use of third-party products in the system build-up.

9. Liability

We are liable for intent and gross negligence. For slight negligence we are liable only for breach of essential contractual obligations and limited to the foreseeable damage typical of the contract. Liability for lost profit, indirect damage and consequential damage is excluded in transactions between entrepreneurs.

Liability under the Product Liability Act (Produkthaftungsgesetz) and liability for personal injury remain unaffected.

10. Workshops

You book workshop places through the shop like a product. The booking applies to the selected date and the selected location and is binding upon confirmation. The place is only secured once payment has been received.

Up to 7 days before the start, you can move your booking free of charge to another scheduled date, as long as a place is free there. Report the rescheduling to kontakt@materea.at. From the 7th day before the start, rescheduling is no longer possible. Withdrawal from the booking is not provided for; if you do not take part, the price remains payable.

Materea may cancel a date, for example if the number of participants is too low or if the trainer is unavailable. In this case you will be offered a replacement date or a refund of the amount paid. There are no further claims, for example for travel or accommodation costs.

In the workshops, work is carried out with machines, tools and chemical products. You are to follow the trainers' instructions and bring the protective equipment that has been announced. Participation is at your own risk; our liability is governed by section 9.

11. No right of withdrawal

The right of withdrawal under the Distance and Off-Premises Contracts Act (Fern- und Auswärtsgeschäfte-Gesetz) applies to consumers only. As we sell exclusively to entrepreneurs, there is no statutory right of withdrawal. What applies to returns, complaints and workshops is set out on the page Returns and cancellations.

12. Data protection

How we process personal data is set out in the Privacy policy.

13. Choice of law, jurisdiction, final provisions

Austrian law applies, excluding the conflict-of-law rules of private international law and the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from this contract is the court with subject-matter jurisdiction for 8502 Lannach.

The place of performance is Lannach. Should any provision of these terms be invalid, the remaining provisions remain unaffected.
